CONTEST OFFICIAL RULES AND REGULATIONS

  1. The Bell Aliant TV1 Comedy Contest 2017 contest (the “Contest”) is sponsored by Bell Aliant Regional Communications, Limited Partnership (hereinafter referred to as the “Contest Sponsor”). The Contest starts at 10.00am Atlantic Time ("AT") on 10th November 2016 and closes on 30th December 2016 at 10.00 am AT (the “Registration Period”). After the close of the Registration Period, there will be one (1) round of judging, one (1) voting round and a second round of judging as set out below. There are four (4) prizes (the "Prizes") to be won. No purchase necessary. Void where prohibited.
  2. ELIGIBLITY: To enter and to be eligible to win, entrant must be a legal resident of Newfoundland, Prince Edward Island, New Brunswick or Nova Scotia and be the age of majority or older in his/her province of residence at the time of entry. Employees and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsor and its agents, parent, affiliated or related companies, subsidiaries, divisions, and promotional and advertising agencies, administrators are ineligible to enter.
  3. ANY act may enter unless: They were a province winner in the competition last year (it is fine for finalists to re-enter).
  4. HOW TO ENTER To enter the Contest, during the Registration Period visit the website located at http://www.comedybootcamp.ca/ (the “Contest Website”), click on the Contest page and complete and submit your entry by following the instructions found on the Contest page. All entries must include your name, address, age, ten digit day and evening telephone numbers, email address and one (1) original video (maximum 3 minutes in length) (the “Video”) of yourself telling a joke/performing stand-up/being funny. The Contest Sponsor may exclude any Video that is considered, in its entire discretion, to be inappropriate, offensive or distasteful. The Video must comply with the Submission Guidelines provided below. Limit of one (1) entry per individual. If it is discovered that you attempted to enter more than once, all your entries will be void. Entries shall be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
  5. The Contest Sponsor will screen every Video. Any Video that complies with these official rules and regulations (the “Rules”) may be chosen by the Contest Sponsor, at their sole discretion, to be posted on the Contest Website. Any Video that the Contest Sponsor deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules shall be disqualified.
  6. PRIZE: There are 4 Prizes. Each prize consisting of a Funniest New Comedian in New Brunswick / Nova Scotia / PEI / Newfoundland trophy, a brand new Samsung Tablet, a signed James Mullinger CD and the opportunity to open for James Mullinger at an agreed upon date. IMPORTANT NOTE: (i) the winner is solely responsible for all costs associated with attending the Show; (ii) will be required to comply with the Contest Sponsor and the Show producer’s instructions regarding attending and performing at the Show. The winner is not eligible to receive any monetary compensation from the performance of the Show. This portion of the Prize has no retail value.
  7. The Prize must be accepted as awarded. The Prize may not be sold, transferred and is not convertible to cash. Contest Sponsors reserve the right to substitute the Prize in whole or in part in the event that all or any component of the Prize is unavailable. Prize winner is solely responsible for all costs not expressly described herein.
  8. ROUND ONE JUDGING: Between 31st December 2016 and 4th January 2017, a panel of Bell Aliant judges (the “Judges”) will review all eligible Videos received during the Registration Period. The Video received from each eligible entrant shall be judged and assigned a score on the basis of the following equally-weighted criteria: 1) suitability to perform at the Show; 2) creativity; 3) originality; 4) talent; 5) technical merit; 6) humour; and 7) overall quality. The eight (8) entrants from each province associated with the Videos that obtained the highest scores will be selected as potential semi-finalists (the “Semi-Finalists” and each, a “Semi-Finalist”). The odds of becoming a Semi- Finalist will depend on the total number of eligible entries received during the Registration Period and adherence to the judging criteria. All decisions of the Judges are final and binding. Round One Judging is scheduled to be completed on or about 4th January 2016.
  9. The Contest Sponsor, acting reasonably, will attempt to contact each potential Semi-Finalist by telephone immediately after the Round One Judging to notify her that she has been selected as a potential Semi-Finalist. In order to be confirmed as a Semi-Finalist, each Semi-Finalist must meet all eligibility criteria set out in these Rules. Proof of identification must be provided upon request. In the event that a potential Semi-Finalist cannot be contacted within two (2) business days after the Round One Judging and/or does not meet all eligibility criteria, such potential Semi-Finalist will be disqualified and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard and the Contest Sponsor may select the entrant associated with the Video that obtained the next highest score as an alternate potential Semi-Finalist at its sole discretion (in which case, the foregoing provisions of this section shall apply to such new Semi-Finalist).
  10. VOTING ROUND: On 5th January, 2017, the Video of each confirmed Semi-Finalist will be posted on the Contest Website for public voting. The Contest Sponsor reserves the right not to post a Semi-Finalist’s Video and/or to remove a Semi-Finalist’s Video from the Website at any time for any reason whatsoever. The voting period will open at 10.00am AT on 5th January 2016 and will close on 25th January, 2016 at 10.00am AT (the “Voting Period”). There is a limit of one (1) vote per IP address and per person per day (whereby a “day” for the purposes of this limit is defined as beginning at 12:00:01 a.m. AT and ending at 11:59:59 p.m. AT) during the Voting Period. If it is discovered that attempts were made by a voter (or any individual purporting to be a voter) to: (i) vote more than once per day during the Voting Period; (ii) use (or attempt to use) multiple names, identities, email addresses and/or any automated, script, macro or robotic program(s) to submit votes; and/or (iii) engage in systematic voting (for example, by systematically changing a computer’s IP address); then it may result in the disqualification, in the sole and absolute discretion of the Contest Sponsor, of the applicable votes, Video and/or the Semi-Finalist to which such votes relate. Any votes determined by Contest Sponsor to be in violation of these Rules (including, without limitation, votes determined to be coming from any source other than a voter) are subject to disqualification in the sole and absolute discretion of the Contest Sponsor. All votes are subject to verification at any time for any reason. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor) from any voter (or any individual purporting to be a voter) to participate (i.e. vote) in this Contest or for any votes entered, or purportedly entered, by such voter to be considered valid for the purposes of this Contest. Failure to provide such proof in a timely manner may result in disqualification of the applicable votes that cannot be verified to the satisfaction of the Contest Sponsor, in its sole and absolute discretion. The sole determinant of the time for the purposes of a valid vote in this Contest will be the Contest server machine(s). IMPORTANT NOTE: Individuals may encourage other eligible individuals to vote for a Video; however, no form of incentive, inducement, prize or chance of receiving any incentive, inducement, or prize may be offered as part of such encouragement in furtherance of receiving such individual’s vote for any Video. Any individual determined by the Contest Sponsor to be engaging in such behaviour is subject to disqualification, and the corresponding votes, Video and/or Semi-Finalist is subject to disqualification in the sole and absolute discretion of the Contest Sponsor. At its sole discretion, the Contest Sponsor has the right to disqualify any voting that it deems to be fraudulent, in violation of these Rules, unfair to other entrants or that would otherwise undermine the integrity of the Contest.
  11. ROUND TWO JUDGING: On Wednesday 10th February 2017 (in St. John’s, Newfoundland), Wednesday 17th February 2017 (in Halifax Nova Scotia), Friday 26th February 2017 (in Saint John, New Brunswick), Friday 4th March (PEI), 2016 four Finalists from each province, will compete in a live final tv show in their province MC’d by James Mullinger in February and March. The Finalist with the highest score will be deemed the potential Prize winner for that province. In the case of a tie, the Finalist who scored highest on suitability for the show from amongst the tying Submissions will be deemed the potential Prize winner. The odds of winning the Prize will depend on the total number and calibre of eligible Entries received during the Contest Period. Round Two Judging is scheduled to be completed on the night of each show, dates detailed above (the “Selection Date”). The Contest Sponsor will attempt to contact the potential Prize winner, by telephone or email within two (2) business days of the end of the Selection Date. If the potential Prize winner cannot be contacted within two (2) business days of the end of the Selection Date he/she will be disqualified (and will forfeit all rights to the Prize) and the Contest Sponsor reserves the right, in its sole and absolute discretion, to select an alternate potential Prize winner based on the next highest score in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such new eligible winner of the Prize). Proof of identification must be provided upon request. In order to be declared the winner, potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by the Contest Sponsor. Before being awarded the Prize, the potential Prize winner, will be required to sign and return within the time stipulated by the Contest Sponsor, a full release and indemnity form stating, among other things, that: (i) he/she has read and understood these Rules; (ii) grants and assigns all rights in and to his/her appearances and performances in connection with the Prize and/or TV filming for broadcast including, without limitation, all rights of copyright and confirms that she is not currently, nor has ever been, a member of ACTRA, UDS, AFTRA, SAG, AEA or any other guild or union representing performing artists; (iii) agrees to be available and to participate in publicity and/or promotions related to the Contest and/or the Contest Sponsor and/or similar matters; (iv) authorizes the Contest Sponsor to broadcast, publish, disseminate and otherwise use his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice, in connection with any promotion and/or publicity, and/or for general news, entertainment and/or information purposes at no additional compensation to the potential winner, beyond the awarding of or participation in the Prize; (v) accepts the Prize as offered; and (vi) releases the Contest Sponsor from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the Prize. In the event that that a potential winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsor shall have the right to disqualify such potential winner, and draw an alternate potential winner, and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner shall be applied, with the necessary amendments, until the qualified winner has been duly selected.
  12. SUBMISSION GUIDELINES: Videos must be original and not include any third party’s proprietary content, including trade-marks or copyrighted content. Contest Sponsor, in its sole discretion, may disqualify any entrant who uses third party proprietary content, at any time. Contest Sponsor further reserves the right, in its sole discretion, to edit any Video to blur out any trade-marks or to remove any copyrighted content. Contest Sponsor reserves the right to disqualify any Videos that involve anything illegal, potentially or actually dangerous or harmful or containing any element of physical risk, at any time. Any Video that involves a third party that does not choose to be part of the Video may also be disqualified. Videos must not include any illegal, defamatory or in any way obscene content. Videos cannot be a parody or derogatory. Videos remain the property of the entrant, however by entering this Contest, each entrant: (i) represents and warrants that his/her Video is her or her original work and does not infringe on any third party’s copyright, trade-mark or other intellectual property rights; (ii) represents and warrants that he/she has all necessary rights from any third party that appears, or is mentioned, in the Video, including those from the parent or legal guardian if third party is under the age of majority; (iii) grants the Contest Sponsor an unlimited, royalty free, irrevocable, right and license to post the Video on the Contest Website; (iv) grants the Contest Sponsor an unlimited, royalty free, irrevocable, right and license to post the Video on the Contest Sponsor’s TV1 channel; (v) waives all moral rights in the Video in favour of the Contest Sponsor; (v) agrees to release, indemnify, discharge and hold harmless the Contest Sponsor from any claim or liability arising from or related to the Video and/or his/her participation in this Contest. Contest Sponsor assume no responsibility for any claims against infringement of the right of privacy with respect to any Video.
  13. By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsor with respect to any aspect of this Contest, including, without limitation, the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.
  14. All entries become property of Contest Sponsor who assumes no responsibility for garbled, lost, late, delayed, destroyed or misdirected entries, mail, voice messages, e-mail or any computer errors or malfunctions. Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials or data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Contest Sponsor reserves its right to cancel, terminate, modify, amend, extend or suspend the Contest, and select a winner from previously received eligible entries. Contest Sponsor reserves its right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsor reserves its right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest Website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsor reserves its right to seek remedies and damages to the fullest extent of the law. Contest Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest Website.
  15. Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this Contest each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsor for the purposes of implementing, administering and fulfilling this Contest. Contest Sponsor will not sell or transmit this information to third parties except for the purposes of administering this Contest. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in Bell Aliant's Privacy Policy which is available at http://tv1.bellaliant.ca/.   16. In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Rules shall prevail, govern and control.
  17. With the exception of the Videos, all intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
